The Timuay Justice and Governance

"The Timuay Justice and Governance (TJG) also known as the Késéfanang-guwit Timuay in the Téduray and Lambangian vernacular is an ancient system of governance, otherwise known as the Indigenous Political Structure (IPS) with the Customary Laws of the Téduray and Lambangian Indigenous Peoples (IPs) composed of the Ukit, Tegudon and Dowoy as their guide in implementing the governance system within their territory. TJG is operationalized in the remaining traditional territory of the Téduray and Lambangian in portions of Maguindanao Province, ARMM and Sultan Kudarat Province, Region 12, a territory which was left to them by their ancestor Apu Mamalu.

The term Timuay is both a system and a tribal title among the Tédurays and Lambangians. The root word is “timu”, meaning, gather. Thus, any one, either men or women who has the capacty to gather people is a Timuay. The Téduray and Lambangian ethnic groups are among the 110 Indigenous Peoples listed by the National Commission on Indigenous Peoples (NCIP) in the whole country.

The Timuay system is a traditional form o f leadership and tribal based self-governance practiced by the Téduray and Lambangian since time immemorial up to the present. This is characterized by a collective form of leadership and free participation of the magingéd (citizens) through attendance to assemblies and forums called for by the Baglalan or tribal title holders in the different lines of work in the Timuay system of governance.

The central leadership is the Minted sa Inged (roughly interpreted as Supreme Council of Chiefs) headed by the Timuay Labi. The first Timuay Labi was Alim Bandara in 2002 followed by Sannie Bello in 2010. The third will be determined in the 2017 TJG Timfada Limud.

The basic unit of the TJG is the Fenuwo (village) headed by the Timuay. This is where the bulk of the participants during the Timfada Limud came from.

Prior to the enactment of RA 8371, otherwise known as the Indigenous Peoples Rights Act of 1997 (IPRA), the Teduray and Lambangian were able to put into a written form the Tegudon - Teduray version as early as 1994 and was officially adopted in 1995 as seen in the logo of the Timuay Justice and Governance (TJG). However, the TJG operation before IPRA was clandestine due to bad experiences of Teduray and Lambangian leaders during the alangkat (defensive mode) period whereby tribal activities were outlawed by the commonwealth government in their efforts to integrate the indigenous peoples in mainstream government. The alangkat however is not a movement against the commonwealth government but rather a process of tribal consolidation to protect and promote customary laws and spirituality.

In early 1990s, indigenous peoples awareness for the right to self-determination spread wide throughout the country that led to the enactment of IPRA in 1997. The four (4) bundles of rights recognized in IPRA are on (1) ancestral domains; (2) self-governance and empowerment; (3) social justice and human rights; and, (4) cultural integrity.

The IPRA gave window of opportunity for the transformation of the TJG operation from clandestine into a genuine and legal operation as legitimate indigenous peoples’ self-governance system. But another story if we talk of IPRA in the Autonomous Region in Muslim Mindanao (ARMM) where the implementation of IPRA is not yet resolve to the moment. However, IPRA is a national law and ARMM is still within the jurisdiction of the Philippine State, hence, IPRA has a jurisdiction over the ARMM. This is manifested by NCIP En Banc Resolution to delineate the Ancestral Domain of the Teduray and Lambangian.

2. RA No. 8371 of Indigenous Peoples Rights Act of 1997 (IPRA)
3. Muslim Mindanao Autonomy Act No. 241 of 2008 (MMAA No. 241

The Timfada Limud

The Timfada Limud refers to a big gathering of Teduray and Lambangian baglalan (tribal title holders) for decision making relating to review of the customary laws, program of governance and installation of baglalan for the Inged level. Other issues of best interest to the tribes shall also be discussed and can be decided in the Timfada Limud.

There is no historical data as to when was the last Timfada Limud by our ancestors. In fact, there are many interpretations of Timfada Limud. One interpretation is that Timfada Limud is a person, the highest decision maker. And the current application is based on this interpretation but not as a single person making his/her decision but a group of persons preferably key leaders from the different parts of the Inged making important decision, hence the TJG 2017 Timfada Limud.

In modern day implementation, the TJG 2017 Timfada Limud is our 3rd Timfada Limud. The first was conducted at Kansad Gadung in 2002 and the 2nd was at the Upi Municipal Gymnasium at Nuro, Upi, Maguindanao in 2010. And today, the venue of the TJG 2017 Timfada Limud is once again at the Upi Municipal Gymnasium, Nuro, Upi, Maguindanao.

Objectives:
1. Review and amend if necessary the Teduray and Lambangian customary laws (Tegudon, Ukit and Dowoy);
2. Installation of the Minted sa Inged and Fagilidan;
3. Consolidation and submission of positions on the issue of Peace; IP Party Building; Federalism and Ancestral Domains delineation;
4. Get responses and support from responsible government offices and agencies and from the rebel forces talking peace with the Philippine government"

Pigilan ang Diktadurya! Baguhin ang Sistema! Isulong ang Tunay na Pagbabago at Demokrasya!

Mahalagang maunawaan ng bawat mamamayan ang mas malalim na dahilan sa paggunita ng People Power Revolution o EDSA Revolution ngayong Pebrero 25, 2017. Higit pa sa pag-alsa ng sambayanang Pilipino laban sa higit dalawang dekadang diktadurya ng rehimeng Marcos ay ang pagkilala sa lakas at kakayahan ng mamamayan ng mag-alsa, kumilos at labanan ang hindi makatarungan at hindi makataong pamunuan. Ang palagiang pag-alala at pagsusuri sa mga nangyari sa nakaraan ay kinakailangan upang ito’y hindi na maulit pa.
Puno ng sorpresa ang administrasyong ito. Sa mahigit pitong buwang pag-upo nito ay nakakabahala ang mga biglaang deklarasyon, posisyon at panukala. Ang mataas na bilang sa mga napaslang dahil sa druga at ang pagbuhay ulit sa Death Penalty ay nakakabalisa lalo pa’t nangangako ang administrasyong ito ng pagbabago. Kaya naman ay nagkukumahog na ang kanyang mga kaalyado sa Kongreso na maumpisahang matalakay ang nasabing panukala habang binabaliwa ang imbestigasyon sa mga sangkot sa extra-judicial killings. Hayagang sinabi ni Pantaleon Alvarez, ang House Speaker ng kasalukuyang Kongreso, na hindi siya mag-atubiling paalisin sa mga posisyon ang kumokontra sa death penalty. Sa kabila ng malawakang protesta laban sa panukalang ito ay hindi pa rin natitinag ang mga sumusulong nito. Ang ganitong uri ng pamumuno ay hindi na bago at walang pinagkaiba sa mga nagdaang administrasyon. 


Kamakailan lang din ay idineklara ng ng pangulong Duterte ang all-out-war laban sa mga New People’s Army (NPA) at pagtigil sa usaping pangkapayapaan sa pagitan ng National Democratic Front of the Philippines (NDFP). Dahil dito, ay nakapagtala na ng humigit kumulang 30 na sagupaan sa pagitan ng mga sundalo at rebeldeng grupo na kumitil sa buhay ng iilan at labis na nakaapekto sa mga komunidad na pinangyarihan.

Ang Kilusan ng mga Lumalabang Mamamayan para sa Pagbabago ng Bayan (KILOS BAYAN) at Alyansa ng mga Mamamayan para sa Karapatang Pantao (AMKP) ay naniniwala na ang pagbabago ay hindi lamang para sa iilang tao kundi kabahagi ang lahat ng uri ng mamamayan na nakaayon sa karapatang pantao.
Sa ika-31 taong paggunit ng EDSA Revolution, kami ay
 Tutol sa pagpapabalik ng Death Penalty. Kami ay naniniwala na bulok ang sistemang pang-hustisya sa Pilipinas na mas kinikilingan ang mga mayayaman at nasa kapangyarihan. Ang pagbabago sa sistemang panghustisya ang dapat na tugonan at ang pagpataw ng habang buhay na pagkabilanggo sa mabibigat na mga kasalanan ang mas ipatupad kasabay ang pagbibigay ng mga suportang programa para sa pagbabago ng nagkasala. 


 Ideklara ang tigil putukan at ipagpatuloy ang usaping pangkapayapaan ng pamahalaang Pilipinas at ng NDFP. Higit na apektado ang komunidad dahil sa armadong sagupaan at maraming mga sibilyan ang nadamay at nawalan ng hanapbuhay. Tigilan na ng NPA ang malawakang pag-rekrut sa mga katutubo dahil ito ay nagdudulot ng pagkahati-hati at pag-aaway sa pagitan ng mga myembro ng tribu.



 Pagtuonan ng pansin at panahon ang mga serbisyong panlipunan na pangunahing pangangailangan ng mamamayan katulad ng pangakong wakasan ang kontraktwalisasyon sa paggawa at pagbibigay ng regular na trabaho; pagsakatuparan ng desenteng sahuran sa mga manggagawa, pagsasaayos ng sistema sa pagkuha ng benepisyo ng mga senior citizens, regulasyon sa pagtaas ng mga bayarin sa paaralan, at iba pa.



 Hinihimok ang mga mamamayan na patuloy na maging kritikal sa lahat ng anggulo ng pamamahala at maging aktibo sa mga kilusan upang hindi na maulit pa ang hindi makatao at mapang-aping sistema ng pamumuno na tumatak sa kasaysayan ng Pilipinas.

Ang pagiging kritikal at aktibo ng mamamayan ang siyang tunay na diwa ng demokrasya!

TAGUMPAY! TULOY ANG LABAN AT PAGBABANTAY SA KALIKASAN!

Ika-2 ng Pebrero taong 2017 ay nagpahayag sa publiko ang Sekretarya ng Kagawarang Pangkalikasan Gina Lopez na ipapasara nito ang 21 na minahan sa bansa dahil napatunayan umano sa kanilang isinagawang imbestigasyon ang masamang idinulot ng mga ito sa kalikasan at mga komunidad at ang paglabag nito sa mga reglamento ayon sa batas na umiiral sa bansa. Ilan sa mga paglabag ay ang kontaminasyon ng mga ilog at dagat, iligal na pagputol sa mga puno at ang pagkasira sa mga watersheds. Sinuspende din umano ang anim pa at ipinagpaliban muna ang aplikasyon ng isa pa.

It says: "Babae, Lupaing Ninuno at Buhay ay Magkaugnay. Lupaing Ninuno ay Buhay. Babae nagluwal ng Buhay."
Isa itong malaking tagumpay para sa mga komunidad na apektado ng mapangwasak na negosyong ito at maging sa mga nagsusulong ng Katarungang Pangklima. Malaking tagumpay din ito para sa mga komunidad ng mga Katutubo/Lumad na kung saan naroroon itong mga dambuhalang negosyong pagmimina.

Ngayon ay dapat nang ilabas at isilbi ang mga Kautusang Pagsasara at Pagsuspende at mas paigtingin pa ang pagpapatupad sa mga Pangkalikasang mga batas.

Panawagan din natin na:
1.      Papanagutin itong mga korporsayong lumabag sa mga pangkalikasang batas at mga nagkasala at bayaran ang mga kawasakang dulot nila sa mga komunidad;
2.      Pang-institusyon o burukrasyang pagsasaayos at pagpuksa ng kurapsyon at iregularidad sa  loob ng mismong kagawaran;
3.      Pagbibigay suporta sa mga komunidad at pagseguro sa mga karapatan at kapakanan ng mga manggagawang apektado ng pagsasara at suspensyong ito;
4.      Pagbasura sa Philippine Mining Act of 1995 at pagkakaroon ng bagong maka-mamamayan at maka-kalikasang batas na sang-ayon sa mga umiiral na pangkalusugan, pangKatutubo at Karapatang Pantaong mga batas;
5.      Imbestigahan ang kasalukuyang mga eksplorasyon lalo na sa mga Lupaing Ninuno ng mga Lumad, AT IPATIGIL ANG OPERASYON ng mga hindi dumaan sa Free, Prior and Informed Consent (FPIC) ng mga tribu at lumabag sa Indigenous Peoples’ Rights Act ng 1997.
6.      Patuloy na wala munang iaproba o payagang mga kontrata at panibagong operasyon;
7.      Paigtingin pa ang Komprehensibong AUDIT sa mga negosyong Mina, Enerhiya (Fossil-based), Agrikultura, Pagtotroso at Pangkaunlarang Proyekto sa buong bansa lalo na sa Mindanao at mga Lupaing-Ninuno ng mga Lumad at Bangsamoro;
8.      Patuloy na pagbibigay ng puwang sa interes ng Kalikasan at karaniwang mamamayan sa usaping pambansa.

Nasa loob pa rin ng pampulitikang kapangyarihan ang mga Kapitalista na kasosyo ang mga dayuhang mangangapital. Balangkas pa rin ng pambansang ekonomiya ang patabain ang tiyan at bulsa ng mga negosyante kaysa maging malusog ang mga komunidad. Susukatin ang administrasyong Duterte ng hamong ito, Sambayanan at Kalikasan o mga Kapitalistang Kaibigan?

Kaya mas paigtingin pa natin ang ating pagkilos sa lahat ng larangan para sa mga karagdagang tagumpay at patuloy na pagbabantay!

Cavite EPZA factory fire prompts call for stronger labor enforcement - PM

The group Partido Manggagawa (PM) demanded stronger labor and safety enforcement from the Department of Labor and Employment (DOLE) in the wake of the massive factory fire at the Cavite EPZA that resulted to some one hundred injuries and one confirmed dead as of today.

“Export zones should not be independent republics where weak labor and safety rules lead to low wages, proliferation of contractualization and unsafe working conditions. The DOLE should exercise its labor enforcement and inspection powers to the full within economic zones. A big number of the country’s factory workers are now employed in the numerous export zones across the country and especially Calabarzon,” argued Rene Magtubo, PM national chair.

Yesterday members of PM and the Katipunan ng Manggagawang Pilipino (KMP) trooped to the Cavite EPZA to demand a transparent investigation of the factory fire at House Technology Industries (HTI) and immediate assistance for workers injured or killed in the industrial tragedy reminiscent of the Kentex fire in 2015.

“We express our sympathies for HTI workers and their families. Accidents are not acts of divine providence that can be dismissed as unavoidable. Instead, accidents are the result of unsafe acts and therefore preventable by strict enforcement of occupational safety and health and labor standards,” Magtubo insisted.

He noted that despite HTI’s compliance certification, there are apparent occupational health and safety issues since there was a previous fire at HTI in 2012. A 10-hour fire started at the boiler department of the HTI factory in October 19, 2012 and lasted up to early the next day.

“Also we are gravely concerned that out of HTI’s total workforce of some 10,000, only 4,000 are regular workers and the rest are contractual workers deployed by several agencies. Labor inspection should reveal if these agency workers are actually doing the job of regular workers but are being used to evade implementation of mandated wages, benefits and rights,” Magtubo elaborated.

He added that “Further, due to their short-term employment, contractual workers may not be properly informed of health and safety procedures, and probably not participate in fire drills. The proliferation of contractual workers from manpower agencies and labor coops must be stopped not just to advance decent working conditions but also workplace health and safety. Thus we call on DOLE not just to probe HTI but also its sister companies Wu Kong and SCAD where conditions are no different.”

Declaration in the Occasion of the Indigenous Peoples Leaders’ Conference on the Independent Voice in the Peace Processes

IP Leaders signifies their commitment to their demand for an Independent Voice in the Philippine Peace Processes.

We, the tribes of Indigenous Peoples or Lumad in Mindanao celebrating the 19th year of the implementation of the Indigenous Peoples Rights Act 8371 of 1997, gathered at the UDFI, Cotabato City, Mindanao, Philippines through the Indigenous Peoples’ Conference on the Independent Voice in the Peace Processes from October 27-29, 2016 expressed our grave concern over the situation of our ancestral domains and resources within.

Despite the passage of the Indigenous Peoples Rights Act in 1997, the abuses on the four (4) bundles of rights (ancestral domains, self-governance and empowerment, social justice and human rights and cultural integrity) committed by investors, revolutionary groups, and the State itself persisted. In short, the human and collective rights of the Indigenous Peoples such as the killings of leaders, land grabbing, misusing the tribal defense forces to divide the tribes as well as the non-recognition of the system of governance of the Lumad.

At the moment, the government is talking peace with the different revolutionary groups like the CPP-NPA-NDF; MILF, MNLF and others. This is an opportune moment for the Lumad of Mindanao and the Indigenous Peoples of the whole country to demand for our agenda for justice, peace and development as a response to the worsening of our situation as victims affected with the armed conflicts, development aggression, schemes and machinations of groups by organizing and/or recruiting members of the tribes to join their cause within our ancestral domains, violating our individual and collective rights as indigenous peoples and non-recognition of our Indigenous Political Structures (IPS).

Concretely, the gathered twenty (20) tribes of the Lumad in Mindanao established an Independent Peace Panel called “Lumad Husay Mindanaw”. “Husay” is a customary practices to achieve peace and justice. The objectives of the independent panel is to push for a genuine participation and representation of the Lumad in the peace negotiations. The central agenda is to restore the control and power over the ancestral domains and the resources therein through a genuine peoples empowerment of the Lumad and address the historical injustices committed against us.

The Independent IP peace panel is comprised of individuals from the Greater Davao Area, Western Mindanao, Autonomous Region of Muslim Mindanao (ARMM),Central Mindanao and Northern Mindanao. This panel generates its mandate from the 20 gathered tribes from the mentioned territories and their constituencies who are supportive of this initiative.

We, therefore, declare the following demands:

Recognize the Independent Indigenous Peoples Voice in the Peace Processes: “Lumad Husay Mindanao”;
Full recognition of the Indigenous Political Structures (IPS) of every tribes;
A Federal System that recognizes the IP Federal State or IP Autonomy within the Federal States;
Full inclusion of IP Rights under a federal system and the peace processes;
Give Justice and reparation to all victims of Extra-Judicial killings among the IPs.
For the President to Cancel the Joint Administrative Order 2012 (NCIP, DAR, DENR and LRA);
Cancel IFMA, CBFM, ISF, Leased Contract Renewal Agreement – KRDC to DENR, CLOA – DAR and other tenurial instruments that are within the ancestral territories;
Review all existing corporate plantations without a Free and Prior Informed Consent (FPIC);
Repeal the Mining Act of 1995 and review Mining Exploration and Exploitation without FPIC;
For the State and Non-State Actors not to use the the Bagani/tribal defense other than the purpose that they are created by the tribes. We do not recognize and strongly condemn the misuse and abuse of the Bagani by groups outside our tribes.
Implement the Supreme Court Decision for Central Mindanao University, Maramag, Bukidnon and amend the Presidential Proclamation 476 for CMU in favor to Manobo, Talaandig and Higaonon Tribes of Musuan, Maramag, Bukidnon.

MEDIA ADVISORY: IPs demand Independent Voice in the Peace Processes

The current administration of Pres. Rodrigo Duterte’s thrust is to continue with the peace processes with the different non-state actors. This is a very positive development for Mindanao. However, for the indigenous peoples, this doesn’t necessarily mean all positive, especially if in the processes, they will again be left behind and further marginalized. 

In the past peace processes between the government and the different revolutionary fronts (GRP-MNLF, GPH-MILF, GRP-CPLA, GRP-CPP-NPA-NDF) the IPs have been left out. Instead of being the beneficiaries of the negotiations, they were further marginalized and became victims of peace. Their right to Self Determination has been continuously violated by the different actors and Human Rights Violations (IP killings) became most obvious, intensified land conflicts, logging concessions given to rebel groups within the Ancestral Domains of IPs and lately uncertain provisions for IPs within the Bangsamoro Basic Law and the non-recognition of the IPRA (Indigenous Peoples’ Rights Act). It was only in the last peace talks between GPH-MILF that IPs were represented as part of the Bangsamoro Transition Commission (BTC) with some successes in lobbying but still not as independent and equal body. 

With the peace negotiations being revived by the current administration, it has again opened an opportunity for the indigenous peoples to engage, participate and raise their voice for the peace panels to hear. 

With this rationale, the Katawhang Lumad Council of Mindanao Peoples’ Peace Movement held series of consultations (Cotabato City, Davao City and San Francisco, Agusan del Sur) since July – September 2016 which primarily consulted IP leaders and representatives of tribal communities on their issues and concerns pertaining to the Peace Processes in the country and on how they can collectively engage these processes. 

As a culmination of these consultations, an Indigenous Peoples Leaders’ Conference on the Peace Processes will be held this 27-29 October 2016 in time of the observation of the 19th year since the passage of the Indigenous Peoples’ Rights Act at the Ummah Development Foundation, 10th Street, Rosary Heights V, Cotabato City. More than 100 Mindanao IP leaders and tribal communities’ representatives will take part in the event to chart out their agenda for peace and development in their respective communities. With the gathering, it is the utmost hope of the gathered IP leaders that their collective voice will be heard and provided a space in the peace processes.
